Terms of Service

Effective April 21, 2026 · Last updated October 22, 2026

Important: CareMaple is an organisational coordination tool only. It does not provide medical advice, clinical services, or professional caregiving. In any emergency, call 911 immediately.

1. Acceptance of Terms

By creating an account or using CareMaple (“the Service,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to all users, including circle owners, family members, professional caregivers, and viewers.

2. What CareMaple Is

CareMaple is a family care coordination platform. It helps families and care teams manage tasks, schedule appointments, log care notes, store documents, and generate care records for the purposes of organisation, communication, and accountability.

CareMaple is not:

  • A medical provider, clinic, or health system
  • A licensed home care or professional caregiving agency
  • A substitute for professional medical advice, diagnosis, or treatment
  • A HIPAA Business Associate (see Section 9)

3. Your Account

You must be at least 18 years old to create a CareMaple account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate information when signing up and to keep your profile up to date. You may not create an account on behalf of another person without their knowledge.

One person may hold only one account. You may not transfer your account to another person.

4. Care Circles and Invitations

A Care Circle is a private group created around a care recipient. The circle owner controls who is invited and what role they hold. All invitations require explicit acceptance — no one is added to a Care Circle without their consent.

Care Circle actions are recorded in a protected activity history for coordination and accountability. Ordinary users cannot rewrite that history through normal editing controls. This does not override applicable privacy rights or justify indefinite retention of personal information.

5. Acceptable Use

You agree not to use CareMaple to:

  • Post false, misleading, or fraudulent care records
  • Upload content that is illegal, abusive, or violates the rights of others
  • Attempt to gain unauthorised access to another user's circles or data
  • Use the platform to harass, stalk, or harm any individual
  • Reverse-engineer, scrape, or copy any part of the Service
  • Use the platform for commercial purposes outside the scope intended (e.g., reselling access)
  • Circumvent any security or access controls

We reserve the right to suspend or terminate any account that violates these rules.

6. Your Content

You retain ownership of all content you create within CareMaple — tasks, journal entries, documents, and care records are yours. By using the Service, you grant us a limited licence to store and process your content for the sole purpose of providing the Service to you.

You are responsible for the accuracy and legality of the content you submit. Do not upload content you do not have the right to share.

7. Billing and Plans

CareMaple offers Free, Family Plus, and Family Pro plans. Web subscriptions use Stripe. Supported iPhone and iPad builds offer monthly and annual subscriptions through Apple. The purchase screen shows the applicable price and duration before you confirm. Apple subscriptions renew automatically unless cancelled at least 24 hours before the current period ends; Apple charges renewal within 24 hours before that period ends. Manage or cancel Apple subscriptions in your Apple Account subscription settings. Cancellation stops renewal; paid access normally continues to the end of the paid period, subject to refunds or revocation.

Existing web subscriptions remain with Stripe. Do not start an Apple subscription while another recurring CareMaple plan is active. CareMaple pilot access does not automatically start a paid subscription; choosing an Apple subscription starts the terms shown by Apple and does not carry over unused pilot days. Deleting your CareMaple account does not cancel an Apple subscription.

Apple purchases require a supported CareMaple iPhone or iPad version and availability for your account; older versions require an update. Android displays your plan and usage without offering in-app subscription purchases. If Apple purchases are unavailable in your version or for your account, the app does not open a web payment checkout instead.

We reserve the right to change plan pricing with at least 30 days' notice to existing subscribers. Free plan features may change at any time.

Apple processes App Store purchase refunds under its applicable rules; request these through Apple. For a web billing error, contact support@caremaple.com. Nothing in these terms limits mandatory consumer rights.

The Apple app is licensed under the Apple Standard End User License Agreement. These CareMaple terms govern use of the CareMaple service.

8. Proof of Care Reports

The Proof of Care report generates a timestamped, SHA-256 integrity-hashed record of all care activity within a selected date range. While this report is designed to be legally meaningful and tamper-evident, CareMaple makes no warranty as to its legal admissibility in any specific jurisdiction or proceeding.

The report reflects the data entered by users. We are not responsible for the accuracy of user-entered content.

9. Health Information and HIPAA

CareMaple is designed for family and personal care coordination — not for covered entities or business associates as defined under HIPAA (the U.S. Health Insurance Portability and Accountability Act).

If you are a licensed healthcare provider, health plan, or clearinghouse (a “covered entity”), you must not use CareMaple to store Protected Health Information (PHI) as defined under HIPAA without entering into a separate Business Associate Agreement with us.

For families coordinating personal care for a loved one, HIPAA typically does not apply, and CareMaple is appropriate for this use.

10. Disclaimer of Warranties

CareMaple is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be error-free, uninterrupted, or secure. We do not warrant that the Service is suitable for any particular medical, legal, or professional purpose.

Do not rely on CareMaple as your only record of care. In any emergency, call 911 or your local emergency number immediately.

11. Limitation of Liability

To the fullest extent permitted by law, CareMaple shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: loss of data, interruption of care, or reliance on care records. Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Termination

You may start an account deletion request from Settings. A private receipt tracks access closure, deletion, and any remaining retention review. Leaving or archiving a circle and agency offboarding are separate from account deletion. We may suspend or terminate your account if you violate these Terms, without prior notice for serious violations.

Account information and user-contributed content are reviewed for removal under our Privacy Policy, including contributions shared with others. Retained information requires a documented purpose, restricted access, and an expiry or review date. Separately governed agency records, specific legal obligations and active legal holds are assessed individually; an audit trail is not a blanket exemption. Acceptance of a deletion request is not a claim that all erasure has finished.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which CareMaple is registered, without regard to conflict-of-law principles. Any disputes shall be resolved by binding arbitration or in the courts of that jurisdiction.
